3.4.11. Clauses 3.4.6 to 3.4.10 of this article apply only to teachers whose recruitment date is set at or after this Agreement comes into force. This procedure will come into force at the time of signing and will no longer have any force and effect once all collective agreements that begin on September 1, 2018 between the association and the employers have been ratified. 1.5.1 For the purposes of collective bargaining with the association, TEBA is an employer organization within the meaning of the labour code and, for centralized bargaining, has the exclusive power to bargain collectively on behalf of the employer and to engage employers in each agreement with respect to the core concepts. Effective February 13, 2019, this collective agreement will be concluded in accordance with the laws of the Province of Alberta, as amended from time to time, including, but not limited to, the Education Act, the Alberta Human Rights Act, the Collective Education Act (PECBA), the Employment Standards Code and the Labour Relations Code. 1.2 For the purposes of this collective agreement, and notwithstanding the provisions of the Schools Act, Teachers` Day is considered non-compulsory. 3.3.3 Any new teacher who takes office provides the employer, within 45 days of taking office, with a certificate certifying the qualifications to be issued by the teachers` qualification service or proof that he has requested it.
Until the teacher submits the qualification statement in question, the teacher is included in the salary plan in accordance with the last acceptable qualification declaration or according to the minimum training requirements for a certificate of learning. If proof of the certificate of aptitude application is submitted within forty-five days, the teacher is paid retroactively on the start date of the current school year`s service period. If proof of this application is not provided within forty-five days, the treatment is appropriate effective on the first day of the month following the submission of a declaration of qualification or proof of application.
